General Terms of Service for the "Smart Business Card" Web Application
Article I. – Introductory Provisions
1.1. These General Terms and Conditions (hereinafter referred to as the "Terms") govern the relationship between the service provider mindsystem.cz, ID No.: [INSERT], with its registered office at: [INSERT] (hereinafter referred to as the "Provider") and the user (hereinafter referred to as the "User") of the "Smart Business Card" web application (hereinafter referred to as the "Service").
1.2. The Service enables Users to create, manage, and host simple web pages (multi-purpose business cards) in a basic free version with defined limitations, or in an extended paid version with higher limits.
1.3. By registering for or using the Service, the User confirms that they have read these Terms and agrees to them.
Article II. – Service Description
2.1. Basic (Free) Version includes: * Hosting for one web business card * Basic template design * Limited storage space for images and files ([INSERT] MB) * Basic content management features * Display of the Provider's advertisements on the web business card * A subdomain in the format user.smart-business-card.cz * Basic visitor statistics * Technical support limited to email communication
2.2. Premium (Paid) Version additionally includes: * Ability to host multiple web business cards (quantity according to chosen plan) * Extended design customization options * Significantly higher storage space ([INSERT] GB and more) * Advanced features (e.g., contact forms, map integrations) * Absence of the Provider's advertisements * Ability to connect a custom domain * Advanced visitor analytics * Prioritized technical support (email, chat, phone) * Regular data backups
Article III. – Registration and User Account
3.1. To use the Service, registration via the form on the mindsystem.cz website is required.
3.2. The User is obliged to provide true, accurate, and complete information and to keep it updated.
3.3. The User is responsible for securing their account and password. They bear full responsibility for all activities conducted under their account.
3.4. The Provider reserves the right to cancel the account of a User who violates these Terms or applicable laws.
Article IV. – Terms of Use
4.1. The User undertakes not to use the Service for: * Disseminating harmful, illegal, vulgar, defamatory, racist, or otherwise inappropriate content * Infringing copyrights or other intellectual property rights * Sending unsolicited commercial communications (spam) * Hosting pages with adult content without appropriate warnings and age restrictions * Activities that could harm the operation or reputation of the Service
4.2. The User is solely responsible for the content they publish on their web business card.
4.3. The Provider reserves the right to remove content violating these Terms without prior notice.
Article V. – Payments and Billing
5.1. The basic version of the Service is provided free of charge, with the possibility of limitation or termination at the Provider's discretion.
5.2. The premium version is subject to fees according to the current price list published on mindsystem.cz.
5.3. Payment is made via subscription for a chosen period (month/year).
5.4. In case of non-payment of the subscription, premium access may be suspended or terminated.
5.5. Prices are stated including VAT. The Provider reserves the right to change prices with notification to Users at least 30 days before the change takes effect.
Article VI. – Personal Data Protection
6.1. Personal data protection is governed by separate Privacy Policy available on mindsystem.cz.
6.2. The Provider processes personal data in accordance with the GDPR and other applicable regulations.
Article VII. – Intellectual Property Protection
7.1. All rights to the software, appearance, and functions of the Service are the exclusive property of the Provider.
7.2. The User is granted only a license to use the Service under the conditions set forth in these Terms.
7.3. Content created by the User remains their property, whereby the User grants the Provider a license to host and display this content within the Service.
Article VIII. – Limitation of Liability
8.1. The Service is provided "as is," without warranties of any kind.
8.2. The Provider does not guarantee uninterrupted availability of the Service and is not liable for outages caused by maintenance, technical problems, or force majeure.
8.3. The Provider is not liable for loss of User data. Regular backup of content is recommended, especially in the free version.
8.4. The maximum liability of the Provider is limited to the amount paid by the User for the Service in the last 12 months.
Article IX. – Termination of Service
9.1. The User can cancel their account at any time via the user interface.
9.2. The Provider reserves the right to temporarily or permanently suspend or terminate the provision of the Service to a User who violates these Terms.
9.3. After account termination, the User's data will be deleted within 30 days, unless otherwise required by law.
Article X. – Final Provisions
10.1. These Terms may be amended by the Provider. Users will be informed of changes by email or notification within the application at least 14 days before they take effect.
10.2. Relationships not governed by these Terms shall be governed by the relevant provisions of Czech law.
10.3. Any disputes arising from these Terms will be resolved by the court having jurisdiction according to the registered office of the Provider.
